the middle of a case when the Assize comes on. The first part

of the suggestion would in the first place simply mean shifting

the delays occasioned by the Criminal Sessions from one Court

to the other, and the waste of time during Sessions week would

be as difficult to fill up in the Summary Jurisdiction as in

Original Jurisdiction. But even here there would be just the

same difficulty, I might be in the middle of a Civil case just

when my turn for the Assizes came round, and this would involve

the Puisne Judge's postponing a week's cases. I shall deal at

length with Mr. Wise's work in Summary Jurisdiction specially

in a subsequent paragraph.

But I take this opportunity to repeat what

I have said in previous correspondence that the monthly session

is unnecessary, and that it leads, for reasons fully gone into

before, to exasperating waste of judicial time which might be

better employed in taking civil cases.

Your Excellency is anxious to know whether

every effort has been made to do away with the necessity of the

Third Judge. There is one remedy which would do a great deal

to relieve the pressure, and that is to establish regular

quarterly Assizes, to be taken by both the Chief and the Puisne

Judge. Then everybody would know that for one week at certain

definite periods the Assize was on, and that no work in either

Court
